Effective Dates

In previous videos, Veterans Attorney Jim Fausone has discussed the process of applying for and being granted disability compensation from the Department of Veterans Affairs. This process includes receiving a disability rating, obtaining a service-connection between that injury and time spent in service, as well as a medical diagnosis/medical nexus.

One of the next steps to take is having an effective date. Many veterans believe even though they developed their disability or injury 10-20 years ago, that their effective date should begin at that time as well. The only issue is the process does not work that way.

The way current regulations are written, a veteran’s effective date begins when they formally file a claim with the Department of Veterans Affairs. So, if you are 10-minutes or 10-years out of service and you do not file, you do not receive back-pay for that amount of time.

Vaccine Updates

This is another friendly reminder to our veteran clients out there to please keep doing your part and masking up whenever possible. VA is working hard to get the COVID-19 vaccine distributed to the public. If you click the link below you will be redirected to a COVID-19 Vaccine resource provided by the Department of Veterans Affairs.

If you have done everything to receive a COVID-19 vaccine with no luck, do not give up! We have heard reports of success from veterans who had no luck going through their community but were successful in receiving a vaccine through the VA.

This process is frustrating, but there are so many individuals – not just veterans – trying to receive the vaccine. You may need to try a few times to be successful, but the main message is to not give up hope. Everyone will receive a vaccine.

A few months ago, Veterans Disability Attorney Jim Fausone had the chance to interview Jason Lewis on the Veterans Radio Podcast. Jason is the champion of Vets With Tinnitus, an organization dedicated to assisting and educating the veteran population of the signs and symptoms of Tinnitus. 

Jason spent 10-years in the Army, deploying to areas like Iraq and Afghanistan, and suffers from Tinnitus himself. Jason started this group with the goal of promoting and understanding Tinnitus, possible solutions, what VA has been researching, and much more!

Home of Heroes – William Pitsenbarger

As mentioned in previous installments, Legal Help For Veterans, PLLC owns and operates a Military History and Medal of Honor research website called Home of Heroes.

There’s a hero’s story we host on Home of Heroes about a Vietnam War-era Medal of Honor recipient, William “Pits” Pitsenbarger. Pitsenbarger was a Para jumper in the U.S. Air Force that ultimately lost his life while fighting off advancing Vietnamese forces and simultaneously tending to wounded American soldiers.
