Expanded VA Disability Benefits for Karshi-Khanabad (K2) Air Base Veterans and Survivors

Veterans who served at the Karshi-Khanabad (K2) base in Uzbekistan after September 11, 2001, are now eligible for expanded access to VA benefits.

December 12, 2024

Veterans who served at the Karshi-Khanabad (K2) base in Uzbekistan after September 11, 2001, are now eligible for expanded access to VA benefits. The Department of Veterans Affairs (VA) recently announced new steps to ensure these Veterans—and their survivors—receive the care and compensation they deserve. These changes aim to lower the burden of proof for Veterans suffering from chronic multi-symptom illnesses and ensure their exposure to toxic substances is fully acknowledged during the claims process.

This is a significant development, as the health risks Veterans faced at K2 were substantial. Exposure to contaminants like jet fuel, asbestos, and particulate matter during their service has resulted in numerous long-term health complications. While these new measures are a positive step forward, the claims process can still be overwhelming and complicated. An experienced Veterans’ disability attorney will guide you through this process, protect your rights, and ensure you receive the benefits you deserve.

Recognizing K2 Veterans’ Toxic Exposure and Presumptive Conditions

The VA’s new approach includes a significant step: treating K2 Veterans as Persian Gulf War Veterans, which allows undiagnosed illnesses and chronic multi-symptom illnesses to be considered presumptive conditions. For Veterans, this means that conditions like Gulf War Illness will automatically be assumed to be related to their service at K2, reducing the need to prove a direct connection between their service and their illness.

Many Veterans who served at K2 were exposed to hazardous substances, including volatile organic compounds, jet fuel, asbestos, and lead-based paint. Until now, it has been difficult for K2 Veterans to receive compensation for these exposures due to the high burden of proof. The VA’s decision to classify K2 service as involving toxic exposure risk activities (TERAs) makes it easier for Veterans to receive compensation for illnesses caused by these exposures.

The statistics are promising: Of the approximately 16,000 known K2 Veterans, 13,002 are currently enrolled in VA healthcare, and 11,801 have service-connected conditions. This shift in policy could significantly increase those numbers, offering more Veterans and their families access to the benefits they deserve.

Pre-Decision Reviews and Claims Processing for K2 Veterans

The VA is also introducing new steps to ensure claims submitted by K2 Veterans receive a thorough review before making any decisions. This includes implementing a pre-decisional review of K2-related claims to guarantee that all information, including toxic exposures, is fully considered before deciding. This is a critical safeguard to ensure that no eligible Veteran is overlooked or denied benefits due to incomplete claim assessments.

Additionally, claims processors and examiners will now receive specialized training regarding K2 service and the specific contaminants Veterans were exposed to while stationed there. This ensures that every claim is reviewed with a full understanding of the risks K2 Veterans face. The inclusion of pre-decision reviews further guarantees that any Veteran who files a claim will have every relevant factor considered, from exposures to chronic health issues.

This improved process ensures that Veterans will have a stronger chance of receiving the compensation and healthcare they need without unnecessary delays. However, the claims system remains complex, and working with an experienced Veterans’ benefits attorney can provide the advocacy and support necessary to navigate the VA’s procedures.

How an Attorney Can Help with Your K2 Veterans Disability Claim

While the VA’s expanded recognition of K2-related exposures is a significant advancement, applying for and securing benefits remains complex. Veterans and their survivors can face challenges parsing through paperwork, gathering medical evidence, and ensuring their claims receive the full consideration they deserve.

Working with a Veterans’ disability attorney can make a significant difference. An experienced attorney can assist with:

  • Filing claimsproperly submitting claims with all required documentation can help prevent delays in the process;
  • Gathering medical evidence—-establishing a strong connection between your illness and your service at K2 is crucial;
  • Appeals—if your claim is denied or if you receive a lower rating than expected, an attorney can assist with filing an appeal to ensure your case is reconsidered; and
  • Maximizing benefits—an attorney can help ensure that all your conditions and exposures are fully accounted for, increasing your chances of receiving the maximum compensation.

The VA has made it clear that they are committed to ensuring K2 Veterans receive the care and benefits they deserve. However, the claims process can still be daunting, and many Veterans may be unsure where to start.
